INDIA ENTRY & OPERATIONS

Four India-facing regulatory workstreams

Cross-border activity can involve investment permissions, tax treatment, trade documentation and entity-level reporting. We help define the Indian workstream, organise information and provide the agreed India-side advisory and compliance support, subject to the facts, applicable authorisations and decisions of the relevant authorities.

01 · INVESTMENT & FEMA

Inward FDI & FEMA compliance

Assess the applicable automatic or approval route, investor and sector conditions, and the appropriate Indian entry structure. Scope can include investment documentation and RBI reporting through the FIRMS portal, including applicable FDI filings and annual FLA returns where required. ODI by an Indian entity can be scoped under the rules in force for the proposed transaction.

02 · INTERNATIONAL TAX

Cross-border tax & DTAA

India-side review of treaty eligibility, withholding tax, permanent establishment exposure and transfer-pricing compliance requirements. Remittance documentation, including Forms 15CA/15CB or applicable successor forms, is assessed under the law and portal requirements in force for the transaction and tax year.

03 · EXIM & CUSTOMS

International trade governance

India-side support for Importer Exporter Code (IEC) workflows, Advance Authorisation, RoDTEP, DGFT requirements, customs classification and valuation documentation, and import/export records. Product-specific permissions, duty treatment and customs decisions depend on the goods, route and applicable policy.

04 · INDIA ENTITY SET-UP

Subsidiary, JV & office set-up

Coordinate establishment and ongoing Indian corporate compliance for a wholly owned subsidiary, joint venture, branch office or liaison office. Scope may cover MCA/ROC incorporation and filings, RBI permissions or reporting where applicable, governance records and annual compliance. The permitted structure and approval route depend on the investor, activity and current rules.

Related workstream: international non-profits & FCRA

For Indian charitable recipients and foreign grant-makers, we can scope India-side governance and documentation support for foreign contributions under the FCRA framework. Registration, prior permission and other decisions rest with the competent authority. Explore Trust & Non-Profit Advisory.

A CLEAR PROCESS

From first question to an agreed scope

  1. Describe the situation. Tell us the countries involved, entity type, transaction stage and Indian question.
  2. Initial review. We identify likely Indian workstreams, records, timing constraints and any matters requiring a specialist or regulator.
  3. Written scope. Work begins only after scope, fees, responsibilities and confidentiality terms are agreed in writing.
  4. Coordinated delivery. We provide the agreed India-side support and explain dependencies, filings and next steps.

An enquiry does not create a professional engagement or an NDA. Please do not send PAN, Aadhaar, bank details, passwords or confidential transaction documents through an open form. Request an NDA before sharing sensitive materials if one is required.
